Mandala of Light Terms of Use

Introduction
These terms of use (âTOUâ or âTermsâ) apply to all users of the Mandala of Light platform. Mandala of Light is a platform and offering of spiritual teachings provided by a collective of experienced teachers (collectively, this âPlatformâ or âServicesâ). âWe,â âour,â or âusâ refers to Mandala of Light and its affiliates.
By using the Platform, you agree to these Terms and to the other policies we post. Please read them carefully and let us know if you have any questions. For information about our data practices, please see our Privacy Policy. We can collect and use your information in accordance with those policies.
You indicate your agreement to these Terms by clicking or tapping on a button indicating your acceptance of these Terms, by executing a document that references them, or by using the Services.
If you will be using the Services on behalf of an organization, you agree to these Terms on behalf of that organization and you represent that you have the authority to do so. In such case, âyouâ and âyourâ will refer to that organization.
1. Your Account
When you create an account, you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To create an account, you must be at least 18 years old. âMinorsâ are individuals under the age of 13 (or a higher age as provided in certain countries and territories). None of the Services are intended for use by Minors. If you are a Minor in your place of residence, you may not use the Services.
You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us immediately at [email protected] if you believe your account is compromised. You represent and warrant that you will comply with all laws and regulations applicable to your use of the Services.
1.1. Voluntary Donations.
Mandala of Light may accept voluntary donations. The amounts requested may change at any time. Mandala of Light will endeavor to inform you of any changes in advance. Mandala of Light may change the donation tier amounts at any time. Mandala of Light will let you know of any changes in advance.
2. Privacy
2.1. Privacy.
In the course of using the Services, you may provide data to Mandala of Light (including your personal data) (referred to herein as your âDataâ). We know that by giving us your Data, you are trusting us to treat it appropriately. Mandala of Lightâs Privacy Policy details how we treat your Data, and we agree to adhere to those Mandala of Light privacy policies. You, in turn, agree that Mandala of Light may use and share your Data in accordance with the Mandala of Light privacy policies and applicable data protection laws.
2.2. Confidentiality.
Mandala of Light will treat your Data as confidential information and only use and disclose it in accordance with these Terms (including the Mandala of Light privacy policies). Mandala of Light may disclose your Data when required by law or legal process, but only after Mandala of Light, if permitted by law, uses commercially reasonable efforts to notify you to give you the opportunity to challenge the requirement to disclose.
2.3. Security.
Mandala of Light will store and process your Data in a manner consistent with industry security standards. Mandala of Light has implemented appropriate technical, organizational, and administrative systems, policies, and procedures designed to help ensure the security, integrity, and confidentiality of your Data and to mitigate the risk of unauthorized access to or use of your Data.
If Mandala of Light becomes aware of any unauthorized or unlawful access to the personal data related to your account (âSecurity Incidentâ), Mandala of Light will take reasonable steps to notify you without undue delay after becoming aware of the Security Incident.
3. Your Data
3.1. You Retain Ownership of Your Data.
You retain ownership of all of your intellectual property rights in your Data. Mandala of Light does not claim ownership over any of your Data. These Terms do not grant us any licenses or rights to your Data except for the limited rights needed for us to provide the Services, and as otherwise described in these Terms.
3.2. Limited License to Your Data.
You grant Mandala of Light a worldwide, royalty-free license to use, reproduce, distribute, modify, adapt, create derivative works, make publicly available, and otherwise exploit your Data, but only for the limited purposes of providing the Services to you and as otherwise permitted by the Mandala of Light privacy policies. This license for such limited purposes continues even after you stop using our Services, with respect to aggregate and de-identified data derived from your Data and any residual backup copies of your Data made in the ordinary course of Mandala of Lightâs operations. This license also extends to any trusted third parties we work with to the extent necessary to provide the Services to you. If you provide Mandala of Light with feedback about the Services, we may use your feedback without any obligation to you.
3.3. Representations and Warranties.
You represent and warrant that: (a) you own or control the appropriate rights in and to your Data, including any intellectual property owned by third parties; and (b) you will not submit, upload, or otherwise make available via the Services, any Data or materials that (i) you do not have the rights necessary to use, transmit, publish, or to grant us the license as described herein; or (ii) infringe, misappropriate, or otherwise violate any intellectual property, publicity, or other rights of any third party.
4. Mandala of Light IP
Mandala of Light owns all rights in and to the Platform and Services. Neither these Terms nor your use of the Services grants you ownership in the Services or the Data you access through the Services (other than your Data). These Terms do not grant you any right to use Mandala of Lightâs trademarks or other brand elements.
5. User Data
5.1. User Data.
The Services display Data provided by others that is not owned by Mandala of Light. Such Data is the sole responsibility of the entity that makes it available. Correspondingly, you are responsible for your own Data, and you must ensure that you have all the rights and permissions needed to use that Data in connection with the Services. Mandala of Light is not responsible for any actions you take with respect to your Data, including sharing it publicly. Under no circumstances will Mandala of Light be liable for any Data, any other third-party Data or materials, or any loss or damage resulting from your use of, or reliance on, such Data or other third-party Data or materials. Please do not use Data from the Services unless you have first obtained the permission of its owner, or are otherwise authorized by law to do so.
5.2. Third-Party Resources.
Mandala of Light may publish links in its Services to internet websites maintained by third parties. Mandala of Light does not represent that it has reviewed such third-party websites and is not responsible for them or any Data appearing on them. Trademarks displayed in conjunction with the Services are the property of their respective owners.
6. Account Management
6.1. Keep Your Password Secure.
If you have been issued an account by Mandala of Light in connection with your use of the Services, you are responsible for safeguarding your password and any other credentials used to access that account. You, and not Mandala of Light, are responsible for any activity occurring in your account (other than activity that Mandala of Light is directly responsible for which is not performed in accordance with your instructions), whether or not you authorized that activity. If you become aware of any unauthorized access to your account, you should notify Mandala of Light immediately. Accounts may not be shared and may only be used by one individual per account.
6.2. Keep Your Details Accurate.
Mandala of Light occasionally sends notices to the email address registered with your account. You must keep your email address and, where applicable, your contact details and payment details associated with your account current and accurate.
6.3. Account Inactivity.
Mandala of Light may terminate your account and delete any Data contained in it if there is no account activity (such as a log-in event) for over 12 months. However, we will attempt to warn you by email before terminating your account to provide you with an opportunity to log in to your account so that it remains active.
7. Suspension and Termination of Services
7.1. By You.
You can request deletion of your Kajabi account at any time or leave the Mandala of Light community by sending an email to [email protected]. Such termination and deletion will result in the deactivation or disablement of your account and access to it, and the deletion of Data you collected through use of the Services.
7.2. By Mandala of Light
Mandala of Light may limit, suspend, or terminate the services to you for any of the following reasons: (a) you fail to comply with these Terms, (b) if you use the Services in a way that causes legal liability to us or disrupts othersâ use of the Services. Mandala of Light has no obligation to retain your Data upon termination of the applicable Service.
7.3. Further Measures.
If Mandala of Light stops providing the Services to you because you repeatedly or egregiously breach these Terms, Mandala of Light may take measures to prevent the further use of the Services by you, including blocking your IP address.
8. Changes and Updates
8.1. Changes to Terms.
Mandala of Light may change these Terms at any time for a variety of reasons, such as to reflect changes in applicable law or updates to Services, and to account for new Services or functionality. The most current version will always be posted on the Mandala of Light website. If an amendment is material, as determined in Mandala of Lightâs sole discretion, Mandala of Light will notify you by email. Notice of amendments may also be posted to Mandala of Lightâs website or upon your login to your account. Changes will be effective no sooner than the day they are publicly posted. In order for certain changes to become effective, applicable law may require Mandala of Light to obtain your consent to such changes, or to provide you with sufficient advance notice of them. If you do not want to agree to any changes made to the terms for a Service, you should stop using that Service, because by continuing to use the Services you indicate your agreement to be bound by the updated terms.
8.2. Changes to Services.
Mandala of Light constantly changes and improves the Services. Mandala of Light may add, alter, or remove functionality from a Service it provides to you at any time without prior notice. Mandala of Light may also limit, suspend, or discontinue a Service provided to you at its discretion.
9. Disclaimers and Limitations of Liability
9.1. Disclaimers.
While it is in Mandala of Lightâs interest to provide you with a great experience when using the Services, there are certain things we do not promise about them. We try to keep our online Services up, but they may be unavailable from time to time for various reasons.
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ANY GUIDANCE OR RECOMMENDATIONS THEREIN ARE PROVIDED âAS ISâ AND MANDALA OF LIGHT DOES NOT MAKE WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OR ANY REPRESENTATIONS REGARDING AVAILABILITY, RELIABILITY, OR ACCURACY OF THE SERVICES.
9.2. Exclusion of Certain Liability.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, MANDALA OF LIGHT, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR (A) ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, OR (B) LOSS OF USE, DATA, BUSINESS, REVENUES, OR PROFITS (IN EACH CASE WHETHER DIRECT OR INDIRECT), ARISING OUT OF OR IN CONNECTION WITH THE SERVICES AND THESE TERMS, AND WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF MANDALA OF LIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
9.3 Limitation of Liability.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF EACH OF MANDALA OF LIGHT, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS ARISING OUT OF OR IN CONNECTION WITH THE SERVICES AND THESE TERMS WILL NOT EXCEED US$50.00.
10. Indemnification.
You will indemnify and hold harmless Mandala of Light and its affiliates, officers, agents, and employees from all liabilities, damages, and costs (including settlement costs and reasonable attorneysâ fees) (âIndemnification Amountsâ) arising out of a third party claim regarding or in connection with your use of the Services or breach of these Terms, to the extent that such liabilities, damages and costs were caused by you.
13. Other Terms
13.1 No Waiver.
A partyâs failure or delay to enforce a provision under these Terms is not a waiver of its right to do so later.
13.2 Severability.
If any provision of these Terms is determined to be unenforceable by a court of competent jurisdiction, that provision will be severed and the remainder of terms will remain in full effect. Third Party Beneficiaries.There are no third party beneficiaries to these Terms.
13.3 Survival.
The following sections will survive the termination of these Terms: 2.2, 4, 5, 9, 10.
To be a member of Mandala of Light you must be at least 18 years old. "Minors" are individuals under the age of 13 (or a higher age as provided in certain countries and territories). None of the teachings, services or materials ("Materials") are intended for use by Minors. If you are a Minor in your place of residence, you may not access or use these Materials.
